When Should criminal Cases be Appealed?
If you have reason to believe that you did not get a fair trial the first time, you have the right to appeal the decision. I have dedicated myself to mastering the appeals process, and as a result, I am able to win cases other attorneys could not.
I start by reviewing the records of the case in minute detail, with support from my team of paralegals and investigators. We frequently find that mistakes were made, mistakes that resulted in an unfair conviction, or a sentence that was too harsh and didn’t fit the crime.
Do Lawyers & Judges Really make Mistakes?
Unfortunately, yes. Many times, the defense attorney simply didn’t do their homework. They didn’t interview the right witnesses, or they didn’t file motions that could have helped their client, or they didn’t make sure the jury understood the judge’s instructions about how to make a decision about the case.
Sometimes, the defense attorney simply didn’t frame the argument in the best possible way. Maybe they were inexperienced. Maybe they lacked the specialized knowledge that I have. Or they just didn’t try as hard as they should have, because they were too busy with other cases.
Other times, it is the prosecution, or even the judge, that acted improperly. Maybe the judge allowed the prosecution to present evidence when it should have been suppressed. Or prosecution argued the case to the jury in an improper manner.
Sometimes the prosecution had evidence that could have helped the defendant, but they didn’t make that known. Prosecutors have been known to make deals with witnesses in order to get them to cooperate, without revealing that fact to the court.
